Syllabus

Former business partners on development project appeal and cross-appeal summary judgment decision involving trespass, negligence, and fraud claims. Trial court correctly found one partner not liable for trespass and negligence where that partner was authorized to demolish building on other partner's land. Fraud claim was only partially dismissed and remained pending for trial. Because claim remained pending, there was no final order and the cross-appeal was dismissed for lack of jurisdiction.
