Syllabus

In a common law motion to vacate judgment on a cognovit note, the party seeking to vacate alleged facts that, if true, would have prevented the court from having subject-matter jurisdiction. Under these circumstances, the trial court improperly placed the burden of proof on the party seeking to vacate the judgment, rather than the party that was invoking the court's jurisdiction.
