DOJ seeks PRA authorization for this information collection for
three (3) years. OMB authorization for an ICR cannot be for more than
three (3) years without renewal. The DOJ notes that information
collection requirements submitted to the OMB for existing ICRs receive
a month-to-month extension while they undergo review.
Abstract: The SAFER SKIES Act, Title LXXXVI of the National Defense
Authorization Act for Fiscal Year 2026, as implemented by the interim
final rule codified at 6 CFR part 124 and 28 CFR part 124, extends
counter-UAS detection and mitigation authority to State, local, tribal,
and territorial (SLTT) law enforcement and correctional agencies under
6 U.S.C. 124n(a)(2). This collection covers the coordination,
authorization, reporting, and recordkeeping submissions the rule
requires, made through the designated Federal C-UAS coordination
portal. The current approval was granted on an emergency basis and
expires November 30, 2026. This revision requests a standard three-year
approval, reflects revisions to five instruments (C-UAS-AN, C-UAS-
OPLAN, C-UAS-TTE, C-UAS-ATT, and C-UAS-POR) made during initial
implementation, and re-estimates burden for every instrument. The FBI
received one public comment in response to the 60-day notice, from an
independent researcher. The commenter supported the collection and
raised questions about the cost burden, the basis for the recordkeeping
and plan estimates, the treatment of filed forms under the retention
provisions of 6 CFR and 28 CFR 124.14, access to the instruments, and
opportunities to reduce burden through data reuse and machine-readable
filing. In response, the FBI has added a one-time form training line to
the burden table, split the recordkeeping estimate by agency tier and
raised the mitigation-tier figure, documented the task-level basis for
each estimate in the supporting statement, explained the basis for the
cost estimate, provided the instruments to the commenter, and committed
to adding a State-law citation field to the Extended Retention
Notification, publishing the data schema for each instrument, extending
data reuse to the Post-Operation Report and Semiannual Summary, and
offering a one-step no-activity summary for detection-tier agencies.
The comment and the FBI's response are summarized in the supporting
statement. The FBI is transitioning the instruments from the current
offline, emailed workflow to a secure web portal that will host the
same instruments with the same data elements, authenticate users
through existing federated identity providers, and capture completion
timing for future burden estimates; go-live is expected in the second
or third quarter of fiscal year 2027. Following publication of the 60-
day notice, the FBI also made minor clarifying edits to the
instruments; those edits did not add or remove data elements.
