SUPPLEMENTARY INFORMATION: On August 26, 2026 (91 FR 54941), the NRC
published a direct final rule amending its regulations in part 72 of
title 10 of the Code of Federal Regulations to revise the TN Americas,
LLC Standardized NUHOMS[supreg] Horizontal Modular Storage System for
Irradiated Nuclear Fuel, Certificate of Compliance No. 1004 within the
``List of approved spent fuel storage casks'' to include Amendment No.
19.
In the direct final rule, the NRC stated that if no significant
adverse comments were received, the direct final rule would become
effective on November 9, 2026. The NRC received and docketed three
comment submissions on the companion proposed rule (91 FR 55028; August
26, 2026). An electronic copy of the comments can be obtained from the
Federal Rulemaking website at https://www.regulations.gov under Docket
ID NRC-2026-2806 and is also available in ADAMS under Accession No.
ML26286A192. The NRC evaluated the comments against the criteria
described in the direct final rule and determined that the comments
were not significant and adverse. Specifically, one commenter mentions
higher heat load as a significant change. This higher heat load was
reviewed by the NRC and is documented in section 5.1.1 of the safety
evaluation report (SER) and determined to be acceptable. Another
commenter questioned the lack of site-specific analyses. However,
specific environmental assessments are not required as 10 CFR
51.22(a)(12) contains a categorical exclusion. The same commenter
challenged that the changes would create appreciable differences in
performance of the cask; however, the staff evaluated all proposed
changes and documented the results in the SER.
Other comments were outside the scope of this rulemaking and did
not oppose the rule; propose a change or an addition to the rule; or
cause the NRC to make a change to the rule, the certificate of
compliance, or the technical specifications. Therefore, this direct
final rule will become effective as scheduled.
Dated: October 30, 2026.
For the Nuclear Regulatory Commission.
Araceli Billoch Colon,
Chief, Rulemaking Projects Branch 2, Division of Guidance, Rulemaking,
Economic Analysis, and Technical Editing, Office of Nuclear Material
Safety and Safeguards.
