SUMMARY: Notice is hereby given that the U.S. International Trade
Commission (``Commission'') has determined not to review an initial
determination (``ID'') (Order No. 15) of the presiding administrative
law judge (``ALJ''), granting Complainant The Ergo Baby Carrier, Inc.'s
(``Ergobaby's'') motion for leave to amend the complaint and notice of
institution of investigation (``NOI'') to add a respondent.

SUPPLEMENTARY INFORMATION: The Commission instituted this investigation
on July 27, 2026, based on a complaint filed by Ergobaby of Torrance,
California. 91 FR 46944-45 (July 27, 2026). The complaint, as
supplemented, alleges violations of section 337 of the Tariff Act of
1930, as amended, 19 U.S.C. 1337, in the importation into the United
States, the sale for importation, or the sale within the United States
after importation of certain adjustable child carriers and components
thereof by reason of infringement of claims 1-3, 5, 6, 12, 16, and 17
of U.S. Patent No. 10,426,275 and claims 1, 6-11, 17, 18, and 22-25 of
U.S. Patent No. 12,016,470. Id. at 46945. The Commission's notice of
investigation named the following respondents: Mabe, LLC of Shelley,
Idaho; Quanzhou Baby Nice Infant and Child Products Co., Ltd. of
Quanzhou City, China; Xiamen Funwhale Technology LLC and Xiamen New
Baby Products Co., Ltd. (``Xiamen NBB'') of Xiamen City, China; Koi
Trading Services of Diamond Bar, California; Portier USA, LLC of
Sheridan, Wyoming; Ava + Oliver, LLC of Honolulu, Hawaii; Artipoppe
B.V. of Lexmond, The Netherlands; Bugaboo Xiamen Industrial Co. Ltd. of
Xiamen, China; Bugaboo International B.V. of Amsterdam, The
Netherlands; and Bugaboo North America, Inc. of New York, New York. Id.
The complaint further alleges that a domestic industry exists. Id. The
Office of Unfair Import Investigations is not participating in the
investigation. See id.
On September 16, 2023, Ergobaby filed a motion for leave to amend
the complaint and NOI to add Xiamen Danke Health Technology Co., Ltd.,
a/k/a xiamen danke jiankang keji you xian gong si (``Xiamen Danke'') of
Xiamen, China as a respondent. None of the participating respondents
opposed the motion. See Order No. 15 at 1 (Sept. 24, 2026).
On September 24, 2026, the ALJ issued the subject ID (Order No. 15)
granting Ergobaby's motion. The ID finds good cause to amend the
complaint and NOI because Ergobaby did not know of Xiamen Danke's role
as the manufacturer of certain accused products until Xiamen NBB
disclosed that information in its response to the complaint and NOI.
Order No. 15 at 2. The ID notes that Ergobaby filed its motion three
weeks after learning of Xiamen Danke and four business days after
receiving additional information regarding Xiamen Danke in Xiamen NBB's
discovery responses. Id. The ID further finds that Ergobaby's proposed
amendment would not prejudice the public interest or the rights of the
parties to the investigation because the products manufactured by
Xiamen Danke are already part of the investigation and the
investigation is in the early stages. Id. at 3. No petitions for review
of the subject ID were filed.
The Commission has determined not to review the subject ID. Xiamen
Danke is added as a respondent in this investigation.
The Commission vote for this determination took place on October
26, 2026.
The authority for the Commission's determination is contained in
section 337 of the Tariff Act of 1930, as amended (19 U.S.C. 1337), and
in Part 210 of the Commission's Rules of Practice and Procedure (19 CFR
part 210).

    By order of the Commission.

    Issued: October 26, 2026.
