Abstract
The National Mediation Board (NMB) is issuing this final rule; technical amendment to amend its regulations to reflect a change in address for its Washington, DC headquarters office. This technical amendment is a nomenclature change that replaces outdated addresses with the NMB's current headquarters address. Additionally, this final rule amends the NMB's regulations to eliminate references to the NMB Chief of Staff position, a position that no longer exists in the agency's organization. This action is administrative, technical, and editorial in nature; is necessary to provide accuracy and clarity to the NMB's Rules; and does not alter the rights, duties, or obligations of the public.

NATIONAL MEDIATION BOARD
29 CFR Parts 1203, 1208, and 1209
Change of Address; Technical Amendment
AGENCY: National Mediation Board.
ACTION: Final rule.
-----------------------------------------------------------------------
SUMMARY: The National Mediation Board (NMB) is issuing this final rule;
technical amendment to amend its regulations to reflect a change in
address for its Washington, DC headquarters office. This technical
amendment is a nomenclature change that replaces outdated addresses
with the NMB's current headquarters address. Additionally, this final
rule amends the NMB's regulations to eliminate references to the NMB
Chief of Staff position, a position that no longer exists in the
agency's organization. This action is administrative, technical, and
editorial in nature; is necessary to provide accuracy and clarity to
the NMB's Rules; and does not alter the rights, duties, or obligations
of the public.
DATES: The final rule is effective October 27, 2026.
FOR FURTHER INFORMATION CONTACT: John Gross, Counsel, National
Mediation Board, Office of Legal Affairs, P.O. Box 23300, Washington,
DC 20026; telephone number: 202-815-1647; email address: <a href="/cdn-cgi/l/email-protection#2c4b5e435f5f6c42414e024b435a"><span class="__cf_email__" data-cfemail="0562776a7676456b68672b626a73">[email protected]</span></a>.
SUPPLEMENTARY INFORMATION: The NMB maintains regulations in title 29,
parts 1201-1209 of the Code of Federal Regulations, a number of which
identify the agency's Washington, DC headquarters address and/or a
staff position that no longer exists in the agency's organization. On
August 1, 2026, NMB's Washington, DC headquarters office relocated from
1301 K St. NW, Suite 250-E, Washington, DC 20005 to 445 12th St. SW,
Suite 2500, Washington, DC 20024. This final rule updates NMB's
regulations at 29 CFR 1203.1, 1203.3(a), 1208.2(a), 1208.2(b)(6)(ii),
1208.2(c), 1208.7(a), 1209.07(f), and 1209.08(d) to reflect the NMB's
current headquarters address and eliminate references to the non-
existent staff position. The NMB has already notified the public of the
address change on its website and through other means of communication.
Regulatory Analysis
A. Administrative Procedure Act
This action is taken under NMB's authority, at 5 U.S.C. 552, to
publish regulations in the Federal Register. Under the Administrative
Procedure Act (APA), at 5 U.S.C. 553(b)(3)(B), statutory procedures for
agency rulemaking do not apply ``when the agency for good cause finds
(and incorporates the finding and a brief statement of reasons
therefore in the rules issued) that notice and public procedure thereon
are impracticable, unnecessary, or contrary to the public interest.''
The NMB finds that such notice and public procedure are impracticable,
unnecessary, or contrary to the public interest, on the grounds that:
(1) These amendments are technical and non-substantive; and (2) the
public benefits from timely notification of a change in the official
agency headquarters address, and further delay is unnecessary and
contrary to the public interest. Similarly, because this final rule
makes no substantive changes and merely reflects, in existing
regulations, a change of address and the removal of references to a
staff position that no longer exists in the agency, this rule is not
subject to the effective date limitation of 5 U.S.C. 553(d).
B. Congressional Review Act
As this is a rule of agency organization, procedure, or practice
that does not substantially affect the rights and obligations of non-
agency parties, it is not a ``rule'' covered by the Congressional
Review Act, 5 U.S.C. 804(3)(C).
C. Unfunded Mandates Reform Act of 1995
This rule will not result in the expenditure by state, local, and
tribal governments, in the aggregate, or by the private sector, of $100
million or more in any one year, and it will not significantly or
uniquely affect small governments. Therefore, no actions were deemed
necessary under the provisions of the Unfunded Mandates Reform Act of
1995 (Pub. L. 104-4).
D. Executive Orders 12866, 14192, and 13563
This rule is ``not significant'' under Executive Order 12866;
therefore, the rule is exempt from the provisions of Executive Order
14192. The benefit of the rule in providing clarity to the public on
the current address of the
[[Page 67481]]
agency's Washington, DC headquarters office and eliminating references
in the NMB's regulations to a position that no longer exists within the
agency outweighs any costs to the public, which are minimal or non-
existent.
E. Regulatory Flexibility Act: Small Business
The NMB certifies that this rule will not have a significant impact
on a substantial number of small entities under the Regulatory
Flexibility Act (RFA), 5 U.S.C. 601 et seq., as amended by the Small
Business Regulatory Enforcement Fairness Act of 1996 (SBREFA) (Pub. L.
104-121). The RFA applies only to rules for which an agency publishes a
general notice of proposed rulemaking pursuant to 5 U.S.C. 553(b) of
the APA. Consistent with section 553(b)(3)(B) of the APA, and as noted
above, the NMB has determined for good cause that general notice and
opportunity for public comment is unnecessary because the rule makes
only technical changes to its regulations and does not alter any
substantive standard, and, therefore, the NMB is not issuing a notice
of proposed rulemaking. Accordingly, the NMB has concluded that a
regulatory flexibility analysis under the RFA is not required. We are
taking this action to ensure our Rules reflect updated and accurate
information for the public.
This action is not a major rule as defined by section 804 of the
SBREFA. This rule will not result in an annual effect on the economy of
$100 million or more; a major increase in costs or prices for
consumers, individual industries, federal, state or local government
agencies, or geographic regions; or significant adverse effects on
competition, employment, investment, productivity, innovation, or on
the ability of U.S.-based companies to compete with foreign-based
companies in domestic and export markets.
F. Paperwork Reduction Act
This rule does not contain information collection requirements, and
a submission to the Office of Management and Budget (OMB) under the
Paperwork Reduction Act of 1995, 44 U.S.C. 3501, et seq., is not
required.
