Abstract
In accordance with the requirements of the Paperwork Reduction Act of 1995 (PRA), the OCC, the Board, and the FDIC (the agencies) may not conduct or sponsor, and the respondent is not required to respond to, an information collection unless it displays a currently valid Office of Management and Budget (OMB) control number. The Federal Financial Institutions Examination Council (FFIEC), of which the agencies are members, has approved the agencies' publication for public comment of a proposal to revise and extend for three years the Consolidated Reports of Condition and Income (Call Report) (FFIEC 031, FFIEC 041, and FFIEC 051) which is currently an approved collection of information. The agencies are requesting comment on revisions to these collections related to an interim final rule issued by the FDIC that implements section 902 of the 21st Century ROAD to Housing Act. The agencies received emergency approval from OMB for these revisions.

SUPPLEMENTARY INFORMATION:
I. Report Summary (Call Report)
The agencies propose to extend for three years, with revision,
their information collections associated with the FFIEC 031, FFIEC 041,
and FFIEC 051 Call Report.
Report Title: Consolidated Reports of Condition and Income (Call
Report).
Form Number: FFIEC 031 (Consolidated Reports of Condition and
Income for a Bank with Domestic and Foreign Offices), FFIEC 041
(Consolidated Reports of Condition and Income for a Bank with Domestic
Offices Only), and FFIEC 051 (Consolidated Reports of Condition and
Income for a Bank with Domestic Offices Only and Total Assets Less Than
$5 Billion).
Frequency of Response: Quarterly.
Affected Public: Business or other for-profit.
OCC
OMB Control No.: 1557-0081.
Estimated Number of Respondents: 934 national banks and Federal
savings associations.
Estimated Average Burden per Response: 41.38 burden hours per
quarter to file.
Estimated Total Annual Burden: 154,596 burden hours to file.
Board
OMB Control No.: 7100-0036.
Estimated Number of Respondents: 705 State member banks.
Estimated Average Burden per Response: 45.21 burden hours per
quarter to file.
Estimated Total Annual Burden: 127,492 burden hours to file.
FDIC
OMB Control No.: 3064-0052.
Estimated Number of Respondents: 2,657 insured State nonmember
banks and State savings associations.
Estimated Average Burden per Response: 38.81 burden hours per
quarter to file.
Estimated Total Annual Burden: 412,473 burden hours to file.
The estimated average burden hours collectively reflect the
estimates for the FFIEC 031, the FFIEC 041, and the FFIEC 051 reports
for each agency. When the estimates are calculated by type of report
across the agencies, the estimated average burden hours per quarter are
86.25 (FFIEC 031), 55.56 (FFIEC 041), and 34.99 (FFIEC 051). The
revisions to the Call Report form and instructions in this notice do
not have a material impact on the existing burden estimates. The
estimated burden per response for the quarterly filings of the Call
Report is an average that varies by agency because of differences in
the composition of the institutions under each agency's supervision
(for example, size distribution of institutions, types of activities in
which they are engaged, and existence of foreign offices).
Type of Review: Extension and revision of currently approved
collections. In addition to the proposed revisions discussed below, the
Call Report is periodically updated to clarify instructional guidance
and correct grammatical and typographical errors on the forms and
instructions which are published on the FFIEC website.\1\ These non-
substantive updates may also be commented upon.

---------------------------------------------------------------------------
Legal Basis and Need for Collections
The Call Report information collections are mandatory: 12 U.S.C.
161 (national banks), 12 U.S.C. 324 (State member banks), 12 U.S.C.
1817 (insured
[[Page 67652]]
State nonmember commercial and savings banks), and 12 U.S.C. 1464
(Federal and State savings associations). At present, except for
selected data items and text, these information collections are not
given confidential treatment.
Banks and savings associations submit Call Report data to the
agencies each quarter for the agencies' use in monitoring the
condition, performance, and risk profile of individual institutions and
the industry as a whole. Call Report data serve a regulatory or public
policy purpose by assisting the agencies in fulfilling their shared
missions of ensuring the safety and soundness of financial institutions
and the financial system and protecting consumer financial rights, as
well as agency-specific missions affecting Federal and State-chartered
institutions, such as conducting monetary policy, ensuring financial
stability, and administering Federal deposit insurance. For many
institutions, the Call Report is the source of the most current
statistical data available for identifying areas of focus for on-site
and off-site examinations. Among other purposes, the agencies use Call
Report data in evaluating institutions' corporate applications,
including interstate merger and acquisition applications for which the
agencies are required by law to determine whether the resulting
institution would control more than 10 percent of the total amount of
deposits of insured depository institutions in the United States. Call
Report data also are used to calculate risk-based assessments for
insured depository institutions.
II. Current Actions
Section 29 of the Federal Deposit Insurance Act (FDI Act) restricts
insured depository institutions that are less than well capitalized
from accepting brokered deposits. Reciprocal deposits \2\ obtained,
directly or indirectly, from or through the mediation or assistance of
a deposit broker are a subset of brokered deposits and generally must
be reported as brokered deposits unless an exception applies. Section
29(i) of the FDI Act provides a limited exception for reciprocal
deposits to allow an insured depository institution that qualifies as
an ``agent institution'' to exclude from treatment as brokered deposits
a limited amount of reciprocal deposits. Reciprocal deposits held by an
institution that does not qualify as an agent institution, must be
treated as brokered deposits.
---------------------------------------------------------------------------
\2\ See 12 U.S.C. 1831f(i); 12 CFR 337.6.
---------------------------------------------------------------------------
Section 902 of the 21st Century ROAD to Housing Act (Housing Act),
which became law on July 11, 2026, amended the limited exception for
reciprocal deposits in section 29(i) of the FDI Act in two principal
respects. First, section 902 revised one of the three methods by which
an insured depository institution may qualify as an agent institution.
Previously, the first method required an insured depository institution
to be well capitalized and to have a composite condition of
``outstanding'' or ``good,'' corresponding to a CAMELS composite rating
of ``1'' or ``2.'' Under the revised provision, an institution may
qualify under this method if, when most recently examined, the
institution was assigned a composite CAMELS rating of ``1,'' ``2,'' or
``3'' and is well capitalized. Second, section 902 replaced the
calculation of the maximum amount of reciprocal deposits that can be
treated as not being brokered deposits under the limited exception,
known as the general cap, with a tiered calculation based on the agent
institution's total liabilities. Under the amended general cap, an
agent institution may exclude from treatment as brokered deposits an
amount of reciprocal deposits equal to the sum of:
1. 50 percent of the portion of the institution's total liabilities
that is less than or equal to $1 billion;
2. 40 percent of the portion of total liabilities that is greater
than $1 billion but less than or equal to $10 billion; and
3. 30 percent of the portion of total liabilities that is greater
than $10 billion but less than or equal to $96,333,333,333.
On August 27, 2026, the FDIC Board of Directors approved an interim
final rule,\3\ effective September 1, 2026, to implement section 902 of
the Housing Act. In response to the interim final rule, the agencies,
under the auspices of the FFIEC, requested and received emergency
approval on September 28, 2026, from OMB to implement revisions to the
Call Report that took effect beginning with the September 30, 2026,
report date. The agencies revised the Call Reports by revising the
instructions to conform to the statutory and regulatory definitions of
brokered and reciprocal deposits for the following items and Glossary
entry:
---------------------------------------------------------------------------
\3\ See 91 FR 56022 (Sept. 1, 2026).
---------------------------------------------------------------------------
<bullet> Schedule RC-E, Memorandum item 1.b., ``Total brokered
deposits'';
<bullet> Schedule RC-E, Memorandum item 1.g., ``Total reciprocal
deposits'';
<bullet> Schedule RC-E, Examples for Calculating the Special Cap;
<bullet> Schedule RC-O, item 9, ``Brokered reciprocal deposits'';
and
<bullet> Glossary entry titled ``Brokered Deposits.''
The agencies also established a new confidentiality exception for
the amounts reported in Schedule RC-O, items 9, ``Brokered reciprocal
deposits,'' and 9.a, ``Fully consolidated brokered reciprocal
deposits,'' respectively.
The new confidentiality exception is considered necessary because
the amounts reported in Schedule RC-O, items 9 and 9.a., when compared
with publicly available total reciprocal deposits reported in Schedule
RC-E, Memorandum item 1.g., could reveal nonpublic supervisory
information about an institution. The agencies are requesting comment
on whether there should be any further changes to the Call Report
instructions developed by the agencies to implement the revisions for
which emergency approval was received from OMB. If modifications are
made to the associated FDIC final rule, the agencies would modify the
information collection revisions in this proposal to incorporate any
necessary changes.
III. Timing
The Call Report revisions made in response to the Housing Act, as
implemented by the FDIC's interim final rule, were approved by OMB
through the emergency clearance process, and these revisions have taken
effect for the September 30, 2026, Call Report.
IV. Request for Comment
Public comment is requested on all aspects of this joint notice.
Comment is specifically invited on:
(a) Whether the revised instructions accurately and clearly
implement the amendments to the limited reciprocal deposit exception
made by section 902 of the Housing Act;
(b) Whether the proposed revisions to the collections of
information that are the subject of this notice are necessary for the
proper performance of the agencies' functions, including whether the
information has practical utility;
(c) The accuracy of the agencies' estimates of the burden of the
information collections as they are proposed to be revised, including
the validity of the methodology and assumptions used;
(d) Ways to enhance the quality, utility, and clarity of the
information to be collected;
(e) Ways to minimize the burden of information collections on
respondents, including through the use of automated collection
techniques or other forms of information technology; and
(f) Estimates of capital or start-up costs and costs of operation,
maintenance, and purchase of services to provide information.
