SUMMARY: This action administratively corrects identified final rules 
published by FAA in the Federal Register between May and September 2026 
so that certain published airspace designation amendments are 
transferred to the most-current revision of FAA Order JO 7400.11, which 
is incorporated by reference.

DATES: Effective date 0901 UTC October 20, 2026. The Director of the 
Federal Register approves this incorporation by reference action under 
1 CFR part 51, subject to the next annual revision of FAA Order JO 
7400.11.

SUPPLEMENTARY INFORMATION:

Authority for This Rulemaking

    The FAA's authority to issue rules regarding aviation safety is 
found in Title 49 of the United States Code. Subtitle I, Section 106 
describes the authority of the FAA Administrator. Subtitle VII, 
Aviation Programs, describes in more detail the scope of the agency's 
authority. This rulemaking is promulgated under the authority described 
in Subtitle VII, Part A, Subpart I, Section 40103. Under that section, 
the FAA is charged with prescribing regulations to assign the use of 
the airspace necessary to ensure the safety of aircraft and the 
efficient use of airspace. This regulation is within the scope of that 
authority as it makes the necessary updates to publication of airspace 
designations in the Federal Register made pursuant to 14 CFR part 71 
within the National Airspace System.

History

    The most-current revision of FAA Order JO 7400.11, Airspace 
Designations and Reporting Points (which lists Class A, B, C, D, and E 
airspace areas, air traffic service routes, and reporting points), is 
incorporated by reference annually in 14 CFR 71.1 as of September 15, 
and amendments to that revision of the Order are published as final 
rules throughout the following 12 months. Certain of these final rules 
are referred to as ``effective date straddling amendments'' because 
there is a mismatch between the effective date of the incorporated 
Order and the effective date of the amendment to the Order. These final 
rules are published in the Federal Register as amendments to the 
current revision of the Order, but contain effective dates that fall 
after the date when the next revision of the Order has been 
incorporated by reference and is effective (i.e., they straddle the 
effective dates of the current and prospective Orders). This occurs 
because the effective date of airspace designations is typically 
delayed by approximately two months after publication of the final rule 
amendment to align with aeronautical charting cycles.

Incorporation by Reference

    This action corrects the identified effective date straddling 
amendments by transferring the amendment to the currently incorporated 
revision of FAA Order JO 7400.11. These amendments will be manually 
integrated into a subsequent revision of FAA Order JO 7400.11.

The Rule

    This action corrects certain final rules (the identified effective 
date straddling amendments) published under 14 CFR part 71 which are 
depicted on aeronautical charts.
    Because these final rules were published while FAA Order JO 
7400.11K was effective and incorporated by reference, but their 
effective dates fell while FAA Order JO 7400.11M was effective and 
incorporated by reference, these rules effectively crossed annual 
update cycles. As a result, these rules were not manually integrated 
into either revision of FAA Order JO 7400.11.
    This action formally transfers these active amendments to FAA Order 
JO 7400.11M, Airspace Designations and Reporting Points, dated July 30, 
2026, and effective September 15, 2026.
    Accordingly, as this is an administrative correction to transfer 
the final rule amendments to the currently incorporated revision of FAA 
Order JO 7400.11, the FAA finds good cause under 5 U.S.C. 553(b)(B) 
that publishing this action for prior notice and public comment is 
unnecessary, and also finds good cause for making this amendment 
effective in fewer than 30 days.

Regulatory Notices and Analyses

    The FAA has determined that this regulation only involves an 
established body of technical regulations for which frequent and 
routine amendments are necessary to keep them operationally current. 
It, therefore: (1) is not a ``significant regulatory action'' under 
Executive Order 12866; (2) is not a ``significant rule'' under DOT 
Order 2100.6B, ``Rulemaking and Guidance Procedure'' (March 10, 2025); 
and (3) is expected to result in, at most, de minimis costs from 
compliance with applicable operating requirements or minor flight 
rerouting for operators choosing to navigate around the

controlled airspace. Since these amendments are routine and the 
expected impact to operators is de minimis, the FAA certifies that this 
rule, when promulgated, does not have a significant economic impact on 
a substantial number of small entities under the criteria of the 
Regulatory Flexibility Act.
