Abstract
The U.S. Department of Commerce (Commerce) published notice to the public in the Federal Register of August 28, 2026 that the U.S. Court of International Trade's (CIT) final judgment was not in harmony with Commerce's covered merchandise inquiry (CMI) determination. Specifically, Commerce amended the CMI determination to find that products cut to length and formed into the rough shape of certain carbon steel butt-weld pipe fittings (butt-weld pipe fittings) in the People's Republic of China (China) represent "unfinished" fittings, which are covered by the scope of the Order, and that when such products are further processed in the Socialist Republic of Vietnam (Vietnam), they remain subject to the antidumping (AD) order on butt- weld pipe fittings from China. This notice did not provide clear notice to parties that the liquidation of entries of these unfinished fittings will be retroactively suspended.

SUMMARY: The U.S. Department of Commerce (Commerce) published notice to
the public in the Federal Register of August 28, 2026 that the U.S.
Court of International Trade's (CIT) final judgment was not in harmony
with Commerce's covered merchandise inquiry (CMI) determination.
Specifically, Commerce amended the CMI determination to find that
products cut to length and formed into the rough shape of certain
carbon steel butt-weld pipe fittings (butt-weld pipe fittings) in the
People's Republic of China (China) represent ``unfinished'' fittings,

Background
On August 28, 2026, Commerce published in the Federal Register a
notice that the CIT's final judgment was not in harmony with Commerce's
CMI determination.\1\ Specifically, Commerce amended the CMI
determination to find that products cut to length and formed into the
rough shape of a butt-weld pipe fitting in China represent unfinished
fittings, which are covered by the scope of the Order,\2\ and that when
such products are further processed in the Vietnam, they remain subject
to the AD order on butt-weld pipe fittings from China.\3\ We did not
provide clear notice to parties that that liquidation of entries of
these unfinished fittings will be retroactively suspended.

Correction
In the Federal Register of August 28, 2026, in FR Doc 2026-17621,
on page 55518, in the third column, correct the notice to include the
following paragraph before the ``Liquidation of Suspended Entries''
section.
Continuation of Suspension of Liquidation
As stated above, Commerce has made an affirmative finding that
unfinished fittings originating from China that undergo the second and
third stages of production in Vietnam, which were the subject of this
referral from U.S. Customs and Border Protection (CBP), are subject to
the scope of the Order. This affirmative in-scope finding applies on a
country-wide exporter, or importer, basis to all products from the same
country with the same relevant physical characteristics as the products
at issue. Therefore, in accordance with 19 CFR 351.227(l)(3), for these
products, Commerce will direct CBP to: (1) continue the suspension of
liquidation of previously suspended entries and apply the applicable
cash deposit rate; (2) suspend liquidation and require a cash deposit
of estimated duties, at the applicable rate, for each unliquidated
entry of the product not yet suspended, entered, or withdrawn from
warehouse, for consumption on or after September 26, 2022, the date of
publication of the notice of initiation of this covered merchandise
inquiry in the Federal Register; and (3) suspend liquidation and
require a cash deposit of estimated duties, at the applicable rate, for
each unliquidated entry of the product not yet suspended, entered, or
withdrawn from warehouse, for consumption prior to September 26, 2022,
but after November 4, 2021.\4\
