Notice of Lodging of Proposed Consent Decree Under the Clean Air 
Act

    On September 25, 2026, the Department of Justice lodged a proposed 
Consent Decree in the United States District Court for the Eastern 
District of Louisiana in the lawsuit entitled United States of America 
et al. v. Nucor Steel Louisiana, LLC, Case No. 2:26-cv-02175-JCZ-EJD.
    The United States filed this action jointly with Louisiana 
Department of Environmental Quality against the Defendant for 
violations of the Clean Air Act and the Louisiana Environmental Quality 
Act. The complaint alleges that the Defendant violated regulations 
under those statutes, including the federally approved provisions of 
the Louisiana State Implementation Plan, and the Defendant's operating 
permits that incorporate those requirements at its Direct Reduced Iron 
processing facility in Convent, Louisiana. Under the proposed Consent 
Decree, the Defendant has agreed to pay a penalty of $1,600,000 and 
perform injunctive relief to resolve the governments' claims.
    The publication of this notice opens a period for public comment on 
the Consent Decree. Comments should be addressed to the Assistant 
Attorney General, Energy and Natural Resources Division, and should 
refer to United States et al. v. Nucor Steel Louisiana, LLC, D.J. Ref. 
No. 90-5-2-1-12815. All comments must be submitted no later than forty-
five (45) days after the publication date of this notice. Comments may 
be submitted either by email or by mail:
