Abstract

The Department of the Treasury's Office of Foreign Assets Control (OFAC) is removing duplicative regulatory provisions, and adding a provision to those parts directing readers to the Sanctions Penalties Regulations where the information is located. OFAC is also moving to an expanded subpart at the beginning of each part information regarding delegations of authority, recordkeeping and reporting requirements, and the Paperwork Reduction Act within multiple parts of the Office of Foreign Assets Control chapter of the CFR.

Removing Duplicative Penalties Information and Reorganizing 
Certain Parts

ACTION: Final rule.

SUMMARY: The Department of the Treasury's Office of Foreign Assets 
Control (OFAC) is removing duplicative regulatory provisions, and 
adding a provision to those parts directing readers to the Sanctions 
Penalties Regulations where the information is located. OFAC is also 
moving to an expanded subpart at the beginning of each part information 
regarding delegations of authority, recordkeeping and reporting 
requirements, and the Paperwork Reduction Act within multiple parts of 
the Office of Foreign Assets Control chapter of the CFR.

Background

    OFAC administers and enforces U.S. economic and trade sanctions 
programs against targeted foreign governments, individuals, groups, and 
entities in accordance with national security and foreign policy goals 
and objectives. OFAC is responsible for civil investigation and 
enforcement of economic sanctions violations under Presidential 
national emergency powers and specific legislation, including the 
International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) 
(IEEPA).

OFAC's Sanctions Penalties Regulations, 31 CFR Part 505

    On September 25, 2026, OFAC issued the Sanctions Penalties 
Regulations, 31 CFR part 505, (91 FR 60821) (the ``Penalties 
Regulations''), to consolidate and update penalty information for 
multiple sanctions regulations into one CFR Part. The Penalties 
Regulations, among other provisions, contain provisions regarding: 
penalties for violations of IEEPA and the United Nations Participation 
Act, as amended (22 U.S.C. 287c(b)) (UNPA); Pre-Penalty Notices and 
responding to such Notices; settlements; penalty impositions; 
administrative collection and referral to the U.S. Department of 
Justice; and Findings of Violation.

Removing Duplicative Regulatory Provisions Now Contained in 31 CFR 505

    Because 31 CFR parts 510, 525, 526, 528, 535, 536, 539, 544, 546, 
547, 548, 549, 551, 552, 553, 555, 558, 560, 561, 562, 566, 569, 570, 
576, 578, 579, 582, 583, 584, 586, 587, 588, 589, 590, 591, and 594 
(the ``affected CFR Parts'') contain information in their subparts G 
that is now duplicated in 31 CFR part 505, OFAC is removing subpart G 
from the affected CFR Parts.
    To aid readers in locating the provisions regarding penalties that 
were formerly in subpart G, OFAC is adding a section to the affected 
CFR Parts, in section 105, referring readers to the Penalties 
Regulations for this information. Additionally, OFAC is updating 
language in the ``Relation of this part to other laws and regulations'' 
section, section 101 of the affected CFR Parts, indicating that the 
Penalties Regulations apply to each of the affected parts.
    In some cases, the penalty information in the Penalties Regulations 
updates or augments information previously found in parts being 
amended. Descriptions of the UNPA criminal penalties in parts 510, 547, 
and 594 had omitted penalties mandated in the Comprehensive Iran 
Sanctions, Accountability, and Divestment Act of 2010 (22 U.S.C. 8514); 
this rule

effectively updates these penalty amounts. Part 576 contained no 
information on UNPA penalties despite being an UNPA program; this rule 
effectively adds information on these penalties for these regulations. 
Parts 569, 579, 586, and 587 each contained a single abbreviated 
section relating to penalties, and parts 562 and 591 contained no 
penalties information at all; this update points users to penalties 
information that is more comprehensive than information previously 
presented as applying to each of these parts.

Reorganizing Provisions Within Individual CFR Parts

    OFAC is also reorganizing most CFR Parts amended in this rule--31 
CFR parts 510, 526, 535, 536, 539, 544, 546, 547, 548, 549, 551, 552, 
553, 555, 558, 560, 561, 562, 566, 569, 570, 576, 578, 579, 582, 584, 
586, 587, 588, 589, 590, 591, and 594--by renaming subpart A as 
``General Provisions'', and moving provisions from other locations in 
these parts to subpart A. Generally, the sections being moved to 
subpart A pertain to: records and reports from subpart F; procedures 
from subpart H; Paperwork Reduction Act from subpart I; and delegation 
of authorities from subpart H. This rule then removes subparts F, H, 
and I. OFAC is also updating cross-references to moved sections in 31 
CFR parts 510, 560, and 561.
    Finally, OFAC is making technical and conforming updates to the 
authority citation in nearly all the affected CFR Parts.

Public Participation

    Because this rule, Removing Duplicative Penalties Information and 
Reorganizing Certain Parts, involves a foreign affairs function, the 
provisions of E.O. 12866 of September 30, 1993, ``Regulatory Planning 
and Review'' (58 FR 51735, October 4, 1993), as amended, and the 
Administrative Procedure Act (5 U.S.C. 553) requiring notice of 
proposed rulemaking, opportunity for public participation, and delay in 
effective date, as well as the provisions of E.O. 14192 of January 31, 
2025, ``Unleashing Prosperity Through Deregulation'' (90 FR 6065, 
February 6, 2025) and E.O. 14219 of February 19, 2025, ``Ensuring 
Lawful Governance and Implementing the President's `Department of 
Government Efficiency' Deregulatory Initiative'' (90 FR 10583, February 
25, 2025) are inapplicable. Because no notice of proposed rulemaking is 
required for this rule, the Regulatory Flexibility Act (5 U.S.C. 601-
612) does not apply.

Executive Order 14294

    Section 5 of E.O. 14294 of May 9, 2025, ``Fighting 
Overcriminalization in Federal Regulations'' (90 FR 20367, May 14, 
2025) directs that all future notices of proposed rulemaking (NPRMs) 
and final rules published in the Federal Register, the violation of 
which may constitute criminal regulatory offenses, should include a 
statement identifying that the rule or proposed rule is a criminal 
regulatory offense and the authorizing statute. E.O. 14294 directs 
agencies to draft this statement in consultation with the Department of 
Justice.
    E.O. 14294 further directs that the regulatory text of all NPRMs 
and final rules with criminal consequences published in the Federal 
Register after May 9, 2025 should explicitly state a mens rea 
requirement for each element of a criminal regulatory offense, 
accompanied by citations to the relevant provisions of the authorizing 
statute.
    Willful violations of the regulations set forth in this final rule 
may be subject to criminal penalties pursuant to 50 U.S.C. 1705 and 
regulations promulgated thereunder. The statutory authority for 
criminal liability requires a mens rea of willfulness as an element 
pursuant to 50 U.S.C. 1705(c). In drafting this statement, OFAC has 
consulted with the Department of Justice.

Paperwork Reduction Act

    The collections of information related to the Regulations are 
contained in 31 CFR part 501 (the ``Reporting, Procedures and Penalties 
Regulations''). Pursuant to the Paperwork Reduction Act of 1995 (44 
U.S.C. 3507), those collections of information have been approved by 
the Office of Management and Budget under control number 1505-0164. An 
agency may not conduct or sponsor, and a person is not required to 
respond to, a collection of information unless the collection of 
information displays a valid control number.

    (b) As set forth in section 218 of the Iran Threat Reduction and 
Syria Human Rights Act of 2012 (Pub. L. 112-158), a civil penalty not 
to exceed the amount set forth in section 206 of IEEPA may be imposed

United States person and established or maintained outside the United 
States violates, attempts to violate, conspires to violate, or causes a

owns or controls the entity, as defined in Sec.  560.215(b)(1).
    (c) Import shipments into the United States of Iranian-origin goods 
in violation of Sec.  560.201 and export shipments from the United 
States of goods destined for Iran in violation of Sec.  560.204 shall 
be detained. No such import, export, or reexport will be permitted to 
proceed, except as specifically authorized by or on behalf of the 
Secretary of the Treasury. Unless licensed, such shipments are subject 
to penalty or seizure and forfeiture action, under the customs laws or 
other applicable provisions of law, depending on the circumstances.
    (d) Attention is directed to 18 U.S.C. 2332d, as added by Public 
Law 104-132, section 321, which provides that, except as provided in 
regulations issued by the Secretary of the Treasury, in consultation 
with the Secretary of State, a U.S. person, knowing or having 
reasonable cause to know that a country is designated under section 
6(j) of the Export Administration Act, 50 U.S.C. App. 2405, as a 
country supporting international terrorism, engages in a financial 
transaction with the government of that country, shall be fined under
