Abstract: The EPA is required under section 183(e) of the Clean Air
Act (CAA) to regulate volatile organic compound (VOC) emissions from
the use of consumer and commercial products. Pursuant to CAA section
183(e)(3), the EPA published a list of consumer and commercial products
and a schedule for their regulation (60 FR 15264). Architectural and
industrial maintenance coatings are included on the list, and the
standards for such coatings are codified at 40 CFR part 59, subpart D.
The information collection includes initial reports and periodic
recordkeeping necessary for the EPA to ensure compliance with federal
standards for VOC in architectural coatings. Respondents are
manufacturers, distributors, and importers of architectural coatings.
Responses to the collection are mandatory under 40 CFR part 59, subpart
D--National Volatile Organic Compound Emission Standards for
Architectural Coatings. All information submitted to the EPA for which
a claim of confidentiality is made will be safeguarded according to the
agency policies set forth in 40 CFR part 2, subpart B--Confidentiality
of Business Information.
    Form Numbers: None.

[[Page 102888]]

Respondents/affected entities: Manufacturers and importers of
architectural coatings.
Respondent's obligation to respond: Mandatory (40 CFR part 59,
subpart D)
Estimated number of respondents: 520 (total).
    Frequency of response: Initially, annually.
Total estimated burden: 24,500 hours (per year). Burden is defined
at 5 CFR 1320.3(b).
Total estimated cost: $1,550,000 (per year), includes $0 annualized
capital or operation & maintenance costs.
Changes in the Estimates: The increase in burden from the most
recently approved ICR is due to an adjustment(s). The adjustment
increase in burden from the most recently approved ICR is due to an
increase in the number of respondents due to growth in the industry.
There is an increase in costs from the most recently approved ICR due
to the increased respondent count and the use of updated labor rates.
This ICR uses labor rates from the most recent Bureau of Labor
Statistics report (September 2022) to calculate respondent burden
costs.

Director, Information Engagement Division.
