DEPARTMENT OF ENERGY
Federal Energy Regulatory Commission
[Project No. 2701-061]
Erie Boulevard Hydropower, L.P.; Notice of Availability of Draft
Environmental Assessment
In accordance with the National Environmental Policy Act of 1969
and the Federal Energy Regulatory Commission's (Commission)
regulations, 18 CFR part 380, the Office of Energy Projects has
reviewed the application for a new license to continue to operate and
maintain the West Canada Creek Hydroelectric Project (West Canada Creek
Project). The West Canada Creek Project is located on West Canada
Creek, in the counties of Oneida and Herkimer, New York.
On June 27, 2022, the Commission issued a notice indicating that
staff intended to prepare a multi-project Environmental Assessment (EA)
for both the West Canada Creek Project and Power Authority of the State
of New York's Hinckley (Gregory B. Jarvis) Hydroelectric Project,
because the projects are located adjacent to each other. However, the
Fiscal Responsibility Act of 2023 now requires that an EA ``shall not
exceed 75 pages, not including any citations or appendices'' (Fiscal
Responsibility Act of 2023, Pub. L. 118-5, 107, 137 Stat 42 (2023)). A
multi-project EA would have exceeded the page limit established in the
Act, so staff has prepared a stand-alone draft Environmental Assessment
(draft EA) for the West Canada Creek Project.
The draft EA contains staff's analysis of the potential
environmental impacts of the project and concludes that licensing the
project, with appropriate environmental protective measures, would not
constitute a major federal action that would significantly affect the
quality of the human environment.
The Commission provides all interested persons with an opportunity
to view and/or print the draft EA via the internet through the
Commission's Home Page (<a href="http://www.ferc.gov/">http://www.ferc.gov/</a>), using the ``eLibrary''
link. Enter the docket number, excluding the last three digits in the
docket number field, to access the document. For assistance, contact
