Abstract

This document requests comments on a petition for rule making filed by 7430 Technologies LLC, proposing to amend the FM Table of Allotments, by allotting Channel 277C2 at Wharton, Texas, as the community's second local service. A staff engineering analysis indicates that Channel 277C2 can be allotted to Wharton, Texas, consistent with the minimum distance separation requirements of the Commission's rules, with a site restriction of 2.1 km (1.3 miles) west of the community. The reference coordinates are 29-18-26 NL and 96-07- 50 WL.

ACTION: Proposed rule.

SUMMARY: This document requests comments on a petition for rule making 
filed by 7430 Technologies LLC, proposing to amend the FM Table of 
Allotments, by allotting Channel 277C2 at Wharton, Texas, as the 
community's second local service. A staff engineering analysis 
indicates that Channel 277C2 can be allotted to Wharton, Texas,

comments on or before April 21, 2023.

    Provisions of the Regulatory Flexibility Act of l980 do not apply 
to this proceeding.
    Members of the public should note that from the time a Notice of 
Proposed Rule Making is issued until the matter is no longer subject to 
Commission consideration or court review, all ex parte contacts are 
prohibited in Commission proceedings, such as this one, which involve 
channel allotments. See 47 CFR 1.1204(b) for rules governing 
permissible ex parte contacts.
