Agency Information Collection Activities; Submission to the
Office of Management and Budget (OMB) for Review and Approval; Comment
Request; Offsets in Military Exports
The Department of Commerce will submit the following information
collection request to the Office of Management and Budget (OMB) for
review and clearance in accordance with the Paperwork Reduction Act of
1995, on or after the date of publication of this notice. We invite the
general public and other Federal agencies to comment on proposed, and
continuing information collections, which helps us assess the impact of
our information collection requirements and minimize the public's
reporting burden. Public comments were previously requested via the
Federal Register on January 14, 2022, during a 60-day comment period.
This notice allows for an additional 30 days for public comments.
Agency: Bureau of Industry and Security, Commerce.
Title: Offsets in Military Exports.
OMB Control Number: 0694-0084.
Form Number(s): None.
Type of Request: Regular submission, extension of a current
information collection.
Number of Respondents: 30.
Average Hours per Response: 12 hours.
Burden Hours: 360.
Needs and Uses: This collection of information is required by the
Defense Production Act (DPA). The DPA requires U.S. firms to furnish
information to the Department of Commerce regarding offset agreements
exceeding $5,000,000 in value associated with sales of weapon systems
or defense-related items to foreign countries or foreign firms. Offsets
are industrial or commercial compensation practices required as a
condition of purchase in either government-to-government or commercial
sales of defense articles and/or defense services as defined by the
Arms Export Control Act and the International Traffic in Arms
Regulations. Such offsets are required by most major trading partners
when purchasing U.S. military equipment or defense related items.
Affected Public: Business or other for-profit organizations.
Frequency: On occasion.
Respondent's Obligation: Mandatory.
Legal Authority: Defense Production Act of 1950, Section 309.
