AGENCY: Federal Communications Commission.
ACTION: Proposed rule.

SUMMARY: The Commission has before it a petition for rulemaking filed
by WNYT-TV, LLC (Petitioner), the licensee of WNYT, channel 12, Albany,
New York. The Petitioner requests the substitution of channel 21 for
channel 12 at in the Table of Allotments.
DATES: Comments must be filed on or before February 23, 2022 and reply
comments on or before March 10, 2022.

SUPPLEMENTARY INFORMATION: In support of its channel substitution
request, the Petitioner states that WNYT has a long history of
significant reception problems given the local terrain. According to
the Petitioner, once the station began operating solely in digital on
VHF channel 12, it received numerous complaints from viewers about the
station's over-the-air signal, and in order to address these problems,
the Petitioner applied for and received modification authorizations to
increase WNYT's effective radiated power and tried other means to
improve viewers' digital reception, including constructing two digital
replacement translators. The proposal will result in a net gain in
service to 289,588 persons within WNYT's predicted noise limited
service contour, and while it will result in a loss population of 210
persons within the predicted contour, all of the population located
within WNYT's original DTV channel 12 noise limited contour will
continue to receive NBC service, except for 130 people.

Communications Commission proposes to amend 47 CFR part 73 to read as
