Abstract
This action proposes to amend Class D airspace and Class E airspace for Portsmouth International Airport at Pease, Portsmouth, NH, due to the decommissioning of the PEASE Very High Frequency Omnidirectional Range Collocated with Distance Measuring Equipment (VOR/DME) and cancellation of the associated approach procedures (SIAPs). This action would also update the airport's name and geographic coordinates. Controlled airspace is necessary for the safety and management of instrument flight rules (IFR) operations in the area.

Proposed Amendment of Class D and Class E Airspace; Portsmouth,

ACTION: Notice of proposed rulemaking (NPRM).

SUMMARY: This action proposes to amend Class D airspace and Class E
airspace for Portsmouth International Airport at Pease, Portsmouth, NH,
due to the decommissioning of the PEASE Very High Frequency
Omnidirectional Range Collocated with Distance Measuring Equipment
(VOR/DME) and cancellation of the associated approach procedures
(SIAPs). This action would also update the airport's name and
geographic coordinates. Controlled airspace is necessary for the safety

SUPPLEMENTARY INFORMATION:
Authority for This Rulemaking
The FAA's authority to issue rules regarding aviation safety is
found in Title 49 of the United States Code. Subtitle I, Section 106,
describes the authority of the FAA Administrator. Subtitle VII,
Aviation Programs, describes in more detail the scope of the agency's
authority. This rulemaking is promulgated under the authority described
in Subtitle VII, Part A, Subpart I, Section 40103. Under that section,
the FAA is charged with prescribing regulations to assign the use of
airspace necessary to ensure the safety of aircraft and the efficient
use of airspace. This regulation is within the scope of that authority,
as it would amend airspace for Portsmouth International Airport at
Pease, Portsmouth, NH, to support IFR operations in the area.
Comments Invited
Interested persons are invited to comment on this proposed
rulemaking by submitting such written data, views, or arguments, as
they may desire. Comments that provide the factual basis supporting the
views and suggestions presented are particularly helpful in developing
reasoned regulatory decisions on the proposal. Comments are
specifically invited on the overall regulatory, aeronautical, economic,
environmental, and energy-related aspects of the proposal.

Availability and Summary of Documents for Incorporation by Reference
This document proposes to amend FAA Order 7400.11E, Airspace
Designations and Reporting Points, dated July 21, 2020, and effective
September 15, 2020. FAA Order 7400.11E is publicly available as listed
in the ADDRESSES section of this document. FAA Order 7400.11E lists
Class A, B, C, D, and E airspace areas, air traffic service routes, and
reporting points.
The Proposal
The FAA proposes an amendment to Title 14 CFR part 71 to amend
Class D airspace, increasing the radius to 4.7 miles from 4.5 miles,
removing Class E airspace area designated as an extension to Class D
and Class E surface area, as it is no longer necessary, and amend Class
E airspace extending upward from 700 feet above the surface at
Portsmouth International Airport at Pease, Portsmouth, NH, due to the
decommissioning of the PEASE VOR/DME and cancellation of the associated
approach procedures (SIAPs). This action would update the airport name
to Portsmouth International Airport at Pease, formerly Pease
International Tradeport. In addition, the FAA would update the
geographic coordinates of the airport and Littlebrook Air Park to
coincide with the FAA's database.
Class D and E airspace designations are published in Paragraphs
5000, 6004, and 6005, respectively, of FAA Order 7400.11E, dated July
21, 2020, and effective September 15, 2020, which is incorporated by
reference in 14 CFR 71.1. The Class E airspace designations listed in
this document will be published subsequently in the Order.
FAA Order 7400.11, Airspace Designations and Reporting Points, is
published yearly and effective on September 15.
Regulatory Notices and Analyses
The FAA has determined that this proposed regulation only involves
an established body of technical regulations for which frequent and
routine amendments are necessary to keep them operationally current.
It, therefore: (1) Is not a ``significant regulatory action'' under
Executive Order 12866; (2) is not a ``significant rule'' under DOT
Regulatory Policies and Procedures (44 FR 11034; February 26, 1979);
and (3) does not warrant preparation of a Regulatory Evaluation as the
anticipated impact is so minimal. Since this is a routine matter that
will only affect air traffic procedures and air navigation, it is
certified that this proposed rule, when promulgated, will not have a
significant economic impact on a substantial number of small entities
under the criteria of the Regulatory Flexibility Act.
Environmental Review
This proposal will be subject to an environmental analysis in
accordance with FAA Order 1050.1F, ``Environmental Impacts: Policies
and Procedures'', prior to any FAA final regulatory action.
