1. At-Will Default

Michigan follows at-will employment subject to significant exceptions.

2. Public Policy Exception

Suchodolski v. Michigan Consolidated Gas Co., 316 N.W.2d 710 (Mich. 1982), recognized public-policy claims in three categories: (1) refusing to violate law, (2) exercising a statutory right, and (3) doing what statute requires. Watassek v. Michigan DOL, 372 N.W.2d 538.

3. Implied Contract

Toussaint v. Blue Cross & Blue Shield of Michigan, 292 N.W.2d 880 (Mich. 1980), is the leading case nationally — handbook provisions, oral assurances, and employer policies can create just-cause employment expectations enforceable in contract.

4. Implied Covenant of Good Faith

Not recognized as standalone (Hammond v. United of Oakland, 483 N.W.2d 652 (Mich. App. 1992)).

5. Statutory Discrimination Claims

Elliott-Larsen Civil Rights Act (ELCRA), MCL 37.2101, covers race, sex (now sexual orientation/gender identity per Rouch World v. Dep't of Civil Rights (2022)), age, religion, height, weight, marital status, etc. Michigan Department of Civil Rights enforces; SOL 3 years for direct court action.
