Can I sue for wrongful termination in Georgia?

1. At-Will Default

Georgia codifies at-will employment in O.C.G.A. § 34-7-1 and consistently refuses to recognize a common-law public-policy tort. Reilly v. Alcan Aluminum Corp., 528 S.E.2d 238 (Ga. 2000).

2. Public Policy Exception

Georgia courts have repeatedly declined to create a Tameny-style tort, deferring exclusively to the legislature (Borden v. Johnson, 395 S.E.2d 628 (Ga. App. 1990)).

3. Implied Contract

Largely rejected. Handbooks with disclaimers do not create contracts. Garmon v. Health Group of Atlanta, 396 S.E.2d 802 (Ga. App. 1990).

4. Implied Covenant of Good Faith

Not recognized in at-will employment.

5. Statutory Discrimination Claims

Georgia Fair Employment Practices Act (O.C.G.A. § 45-19-20 et seq.) covers only public-sector employees. Private-sector relief comes almost entirely from federal law: Title VII, ADEA, ADA, GINA, EPA via EEOC (charge within 180 days since Georgia is non-deferral for most claims).

6. Retaliation Statutes

Georgia Whistleblower Act, O.C.G.A. § 45-1-4 — public employees and contractors only. O.C.G.A. § 34-9-11.1 (NOT a freestanding cause of action for WC retaliation, but the Georgia Workers' Comp Act bars retaliation indirectly). O.C.G.A. § 34-1-3 — jury duty protection. O.C.G.A. § 34-2-3 — wage-and-hour retaliation.

7. WARN Act

No Georgia mini-WARN. Federal WARN applies.

8. Damages

Title VII/ADA: back pay, compensatory/punitive capped $50k–$300k. GWA (public): back pay, reinstatement, attorney's fees. Contract: limited to actual damages.

9. Statute of Limitations

Title VII EEOC: 180 days (Georgia non-deferral); ADEA: 180 days; GWA: 1 year; written contract: 6 years (O.C.G.A. § 9-3-24).
