What are the search warrant requirements in Alabama?
Alabama's warrant procedure is in Chapter 5 of Title 15 of the Code and Rule 3.8 of the Alabama Rules of Criminal Procedure.
1. Constitutional Foundation
The Fourth Amendment is supplemented by Ala. Const. art. I § 5. The Alabama Supreme Court generally interprets § 5 in lockstep with the Fourth Amendment but enforces it independently (Ex parte Tucker).
2. Probable Cause & Affidavit
Ala. R. Crim. P. 3.8 and Ala. Code § 15-5-3 require a sworn written affidavit stating facts establishing probable cause. The warrant must particularly describe the place and items (§ 15-5-3). Alabama applies the Gates totality test. Anticipatory warrants are recognized.
3. Who Issues
Section 15-5-1 authorizes a "judge of the district or circuit court" or a magistrate within whose jurisdiction the property is located. The issuer must be neutral and detached.
4. Execution
Ala. Code § 15-5-9 codifies knock-and-announce: officers may break open doors only after notice of authority and purpose and refusal. No-knock authorization requires a showing of danger or destruction (Laffitte v. State). Alabama requires execution within 10 days of issuance. Nighttime execution requires Rule 3.10(b) authorization for good cause.
5. Scope & Plain View
Search is limited to areas where listed items could reasonably be hidden. Plain-view seizure is permitted when officers are lawfully present and incriminating nature is immediately apparent (Horton v. California).
6. Exceptions to the Warrant Requirement
Consent, search incident to arrest, exigent circumstances, automobile (Carroll), inventory, protective sweep, and Terry frisk.
7. Suppression
Alabama recognizes the Leon good-faith exception (Rivers v. State) and generally tracks federal exclusionary doctrine, including Hudson v. Michigan on knock-and-announce violations.
