What is the homestead exemption in Wisconsin and how do I claim it?

Wisconsin combines a moderate creditor homestead with a refundable income-tax credit.

1. Two Concepts

Wisconsin has (a) the refundable Homestead Credit administered by the Department of Revenue under Wis. Stat. Ch. 71 and (b) a creditor/bankruptcy homestead under § 815.20.

2. Creditor / Bankruptcy Homestead

§ 815.20 protects $75,000 of equity per debtor; joint filers stack to $150,000. The exemption covers a residence on land not exceeding 40 acres outside a city/village or one acre inside.

3. Automatic vs Declaration

The exemption auto-attaches; no recording is needed.

4. Federal Bankruptcy Cap

Wisconsin permits debtors to choose state or federal exemptions. BAPCPA § 522(p)'s $189,050 cap can apply for state-law claims when property was acquired within 1,215 days.

5. Property-Tax Homestead

The Homestead Credit (§ 71.51-71.55) is a refundable income-tax credit of up to $1,168 for homeowners/renters with household income under $24,680. No traditional flat property-tax exemption — but the First Dollar Credit (§ 79.10) and Lottery & Gaming Credit also reduce primary-residence taxes.

6. Filing Property-Tax Exemption

File Schedule H or H-EZ with the Wisconsin income tax return by April 15.

7. Spousal Protections

Wisconsin is a marital-property state (Ch. 766): marital property (including the home) is generally not reachable for one spouse's premarital debts; both spouses must consent to convey homestead.

8. Loss Triggers

Abandonment, sale without reinvestment within two years (§ 815.20(2)), or conversion to commercial use defeats the exemption.

9. Foreclosure & Forced Sale Exceptions

Purchase-money mortgages, property taxes, mechanic's liens, federal liens, marital obligations, and joint judgments override homestead.
