What is the homestead exemption in Texas and how do I claim it?
Texas is widely considered the most homestead-friendly state in the nation.
1. Two Concepts
Texas separates (a) the property-tax homestead exemption (assessed-value reductions filed with the county appraisal district) from (b) the creditor/bankruptcy homestead (unlimited equity protection from most judgment creditors).
2. Creditor / Bankruptcy Homestead
Tex. Const. art. XVI §§ 50-52 and Tex. Prop. Code Ch. 41 protect UNLIMITED equity in a homestead consisting of an urban lot of up to 10 acres or a rural homestead of up to 200 acres (100 acres for a single adult). There is no dollar cap under state law.
3. Automatic vs Declaration

4. Federal Bankruptcy Cap

5. Property-Tax Homestead
After Proposition 4 (2023), the residence homestead receives a $100,000 exemption from school-district taxes plus a 10% annual cap on assessed-value increases (Tex. Tax Code § 11.13).
6. Filing Property-Tax Exemption
File Form 50-114 with the county appraisal district by April 30. Late filings are accepted for up to two years.
7. Spousal Protections

8. Loss Triggers
Abandonment with intent not to return defeats the exemption; sale proceeds are protected for 6 months under § 41.001(c).
9. Foreclosure & Forced Sale Exceptions
Purchase-money loans, taxes, owelty of partition, home-equity loans complying with art. XVI § 50(a)(6), reverse mortgages, and mechanic's liens for improvements are the only permitted forced sales.
