What is the homestead exemption in Minnesota and how do I claim it?

Minnesota offers one of the highest creditor homesteads in the country with a special agricultural tier.

1. Two Concepts

Minnesota has (a) the Homestead Market Value Exclusion and Homestead Classification administered by county assessors under Minn. Stat. Ch. 273 and (b) a creditor/bankruptcy homestead under Minn. Stat. § 510.02.

2. Creditor / Bankruptcy Homestead

§ 510.02 protects $480,000 of equity (as of 2024, indexed every two years) in a residential homestead. Agricultural homesteads with the residence on cultivated land receive $1.2 million.

3. Automatic vs Declaration

The creditor exemption auto-attaches. Property-tax homestead classification requires a one-time application with the county assessor.

4. Federal Bankruptcy Cap

Minnesota allows debtors to choose state or federal exemptions. BAPCPA § 522(p)'s $189,050 cap can apply for property acquired within 1,215 days.

5. Property-Tax Homestead

The Homestead Market Value Exclusion (§ 273.13, subd. 35) excludes 40% of the first $76,000 of market value (maximum $30,400), phasing out at $413,800. Homestead Classification taxes residences at 1.0% of the first $500,000 versus 1.25% for non-homestead. The Senior Citizens Property Tax Deferral (§ 290B) allows seniors 65+ with income under $96,000 to defer taxes exceeding 3% of income.

6. Filing Property-Tax Exemption

File the Homestead Application with the county assessor by December 31 for the following assessment year.

7. Spousal Protections

Both spouses must sign to convey or mortgage the homestead (Minn. Stat. § 507.02), regardless of titling.

8. Loss Triggers

Failure to occupy, conveyance, or renting more than the allowed portion terminates exemptions. Proceeds protected for one year (§ 510.07).

9. Foreclosure & Forced Sale Exceptions

Purchase-money mortgages, property taxes, mechanic's liens, federal liens, and pre-homestead judgments override the exemption.
