What is the homestead exemption in Massachusetts and how do I claim it?
Massachusetts has a robust homestead regime that rewards recording a Declaration of Homestead.
1. Two Concepts

2. Creditor / Bankruptcy Homestead

3. Automatic vs Declaration
The $125,000 automatic homestead requires no action; the larger $500,000 (or $1M elderly couple) requires recording at the Registry of Deeds.
4. Federal Bankruptcy Cap
Massachusetts allows debtors to choose state or federal exemptions. BAPCPA § 522(p)'s $189,050 cap can reduce the state benefit for property acquired within 1,215 days.
5. Property-Tax Homestead
M.G.L. ch. 59 § 5 contains numerous clause exemptions: Clause 41 (seniors), Clause 22 (veterans), Clause 17 (surviving spouses), Clause 37 (blind). Amounts vary by municipality acceptance.
6. Filing Property-Tax Exemption
File the local assessor's exemption form by April 1 of the fiscal year.
7. Spousal Protections
A Declaration of Homestead by either spouse benefits both. Conveyance or release requires both spouses' signatures.
8. Loss Triggers
Recording a new homestead on a different property terminates the prior one (§ 10). Sale proceeds protected for one year for reinvestment (§ 11).
9. Foreclosure & Forced Sale Exceptions
Purchase-money mortgages, property taxes, mechanic's liens, spousal/child support, and federal liens override the homestead.
