5. Boundary Disputes

NJ recognizes boundary by agreement, acquiescence, and estoppel. Survey by NJ-licensed professional land surveyor required. Subdivision approval records often relevant.

6. Encroachment Remedies

NJ courts apply relative hardship balancing for innocent encroachments (Lichtman v. Kuglin, 187 A. 626 precedent line). Equitable considerations weigh heavily in Chancery Division.

7. Express Easement Termination

Release, merger, abandonment (nonuse plus clear intent to abandon), expiration, or end of necessity.

8. Marketable Title
