Can My Employer Read My Emails?

Workplace privacy is a complex area where employer interests in monitoring productivity and protecting assets intersect with employee privacy expectations.

Employer-owned systems. Employers generally have the right to monitor communications on company-owned equipment and accounts. This includes:

  • Company email accounts
  • Work-issued phones and computers
  • Company messaging platforms (Slack, Teams)
  • Internet browsing on company networks
  • Legal basis. The Electronic Communications Privacy Act (ECPA) allows monitoring when the employer provides the communication system, when the employee consents, or when monitoring is done in the ordinary course of business.

    Consent. Many employers include monitoring policies in employee handbooks or acceptable use policies. By signing these, you consent to monitoring. Even without explicit consent, courts have generally upheld employer monitoring of company systems.

    Personal accounts and devices. Employers have less authority to monitor personal email accounts and personal devices. However, if you access personal accounts on company equipment, those communications may be captured by monitoring software.

    State laws. Some states (like Connecticut and Delaware) require employers to notify employees of electronic monitoring. California provides stronger privacy protections.

    Best practices for employees:

  • Assume anything on company systems can be read by your employer.
  • Use personal devices and accounts for private communications.
  • Read your company's monitoring and acceptable use policies.
  • Do not store personal files on work computers.
  • Social media. Many states prohibit employers from requiring access to employees' personal social media accounts.
