What money in my bank account is protected from creditors in North Carolina?
1. Federal Floor. Social Security, SSI, SSDI, VA, federal pensions, and OPM annuities are protected under 42 U.S.C. § 407 and 38 U.S.C. § 5301. The 31 C.F.R. Part 212 two-month rule automatically protects direct-deposited federal benefits.
2. State Wild-Card / Cash Exemption. NCGS § 1C-1601(a)(2) gives a $5,000 wild card for any property usable for bank deposits, but only if no homestead exemption is claimed. § 1C-1601(a)(9) adds $500 in any property as a true wild card.
3. Other Source-Specific Exemptions. § 1-362 protects earnings of debtor for personal services within 60 days when necessary for family support — wage garnishment by ordinary creditors is generally not permitted in North Carolina at all (only for taxes, child support, student loans, court-ordered restitution). § 105-275(7) public assistance, § 96-17 unemployment, § 97-21 workers' comp, retirement benefits all exempt.
