Executive Order on AI Safety Triggers New Agency Rulemaking
Federal agencies continue implementing requirements under the October 2023 Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence. NIST published its AI Risk Management Framework companion documents, the Commerce Department issued reporting requirements for companies developing powerful AI models, and the EEOC issued guidance on AI in employment decisions.
The executive order requires companies developing foundation models that pose serious risks to national security, economic security, or public health and safety to notify the federal government and share safety test results. It also directs agencies to address AI risks in areas including critical infrastructure, healthcare, education, and criminal justice.
Multiple states have enacted or introduced their own AI legislation, creating a patchwork of requirements. The EU AI Act also took effect, adding international compliance obligations.
Practical Impact
AI developers and deployers must monitor rapidly evolving federal and state requirements. Companies using AI in hiring, lending, insurance, or healthcare face particular scrutiny. Develop AI governance frameworks and risk assessment processes now. The lack of comprehensive federal AI legislation means companies face a complex multi-jurisdictional compliance landscape.
